The implementation of municipal policies relating to the promotion of the city of Madrid, the provision of tourist information, the projection of the city’s image at domestic and international level, and the management and exploitation of intellectual property rights deriving from such works as may generate such rights as a result of the aforementioned activities.

And in relation to the touristic promotion of the City of Madrid in both domestic and international tourist markets, it includes:

The promotion and implementation of actions that encourage the loyalty of visitors to the City of Madrid, both through its own actions and in cooperation with Public Administrations or other public or private entities.

This Legal Notice contains information on the terms and conditions of use of the website https://citycard.esmadrid.com which has been created to publicise the tourist card known as the MADRID CITY CARD.

Holders of the MADRID CITY CARD will benefit from discounts and offers in establishments offering Leisure, Shopping, Art, Culture and Gastronomy in the city of Madrid.

The MADRID CITY CARD is aimed at citizens, tourists and visitors to the city in order to promote and boost consumption of tourist products and services in the city of Madrid.

This Legal Notice applied both to non-registered users and to users who have registered via the forms available for that purpose at https://citycard.esmadrid.com.

Accessing, browsing and using said website implies unreserved acceptance of these terms and conditions subject to the same validity and effectiveness as a contract.

ONE. - DEFINITION OF USER

Anyone who accesses and/or makes use of the website https://citycard.esmadrid.com becomes a user thereof, and thereafter accepts, without reservations, these General Terms and Conditions of Use, notwithstanding any Specific Conditions that MADRID DESTINO may establish for registered users of the MADRID CITY CARD.

TWO. - USER OBLIGATIONS AND LIABILITY

The user undertakes to use the website https://citycard.esmadrid.com in accordance with the applicable law, good faith, public order and generally accepted habits and customs. Likewise, the user undertakes not to use said website for illegal purposes or to the detriment of the rights and/or interests of MADRID DESTINO, the Madrid City Council, and/or third parties, and not to cause damage to or prevent the normal operation of https://citycard.esmadrid.com, such as the incorporation of malicious code, regardless of the existence of filters that can disable such code.

Users who access https://citycard.esmadrid.com are authorised to view all the information and contents of the same that are accessible in each section for both registered and unregistered users, and to download or reproduce such accessible content (images, audio-visual archives, brochures, reports and publications) to their devices, in accordance with intellectual property law and the user licence granted in accordance with clause six.

Use made by users shall be the sole and exclusive responsibility of the latter, and in all cases he or she shall hold MADRID DESTINO and/or the Madrid City Council and all other users of https://citycard.esmadrid.com harmless from any damages and/or loss that non-observance of these Terms and Conditions of Use by the user may cause to the user him or herself or to third parties, whether directly or indirectly.

In this regard, MADRID DESTINO reserves the right to deny access to and/or use of https://citycard.esmadrid.com or any of its content and/or services to any user who fails to comply with these General Terms and Conditions of Use and, where appropriate, the Specific Conditions. MADRID DESTINO shall pursue non-compliance with these Terms and Conditions of Use and any improper use of https://citycard.esmadrid.com, exercising any and all civil and criminal actions that may correspond to it by law.

THREE. - USER OBLIGATIONS AND LIABILITY OF MADRID DESTINO

MADRID DESTINO accepts no liability for damages and/or loss of any kind caused to the user or a third party due to:

  • lack of availability, maintenance or proper operation of https://citycard.esmadrid.com, its services or content;
  • lack of usefulness, suitability or validity of https://citycard.esmadrid.com, its services or content in terms of meeting the user’s needs or expectations;
  • errors or a lack of updating of https://citycard.esmadrid.com or its content;
  • the presence of viruses or any other elements in the contents that might lead to damage in computer systems, electronic documents or the files of users of this website or third-party websites.
  • use by a third party, in violation of the security measures established by MADRID DESTINO, of https://citycard.esmadrid.com, its content or services in order to send a virus or to process the data stored by MADRID DESTINO for unauthorised purposes;
  • or, in general, any use of https://citycard.esmadrid.com, its services and/or content made by the user or a third party in breach of the Terms and Conditions of access to and use thereof.

As soon as MADRID DESTINO becomes aware of any of the above incidents, provided that it falls within its scope of action and there are no causes that make it impossible for it so to do, undertakes to do all that is required to rectify them.

In order to improve the services provided by https://citycard.esmadrid.com, MADRID DESTINO reserves the right to modify, unilaterally and without notice, the provision, configuration, design and content thereof, in whole or in part, as well as the terms and conditions of use of the same and access to the services provided, undertaking to give maximum notice to registered users and, in case of changes to the economic conditions for the provision of services offered at least thirty (30) days prior to the date of entry into force of the amendment.

If the registered user does not agree with the new terms and conditions, he/she may cease communications with MADRID DESTINO. A request for cancellation shall be automatic.

Furthermore, MADRID DESTINO reserves the right to interrupt, temporarily suspend or definitively cancel https://citycard.esmadrid.com or any of its component content and/or services, at its sole and entire discretion.

SIX. - INTELLECTUAL PROPERTY. USER LICENCES.

The contents that MADRID DESTINO makes available to the user on https://citycard.esmadrid.com are protected by copyright, and in certain cases, additionally, by image and industrial property rights.

Infringement of intellectual or industrial property rights by users will be subject to the legal consequences of making uses other than those permitted, which constitutes a violation of those rights.

SEVEN. - PRIVACY AND COOKIES POLICY
